This Practice Note addresses emotional distress and other compensatory damages in employment discrimination cases, including the nature of compensatory damages, statutory damage caps under Title VII of the Civil Rights Act of 1964 (Title VII), the Americans with Disabilities Act (ADA), and the Genetic Information Nondiscrimination Act (GINA), discovery and evidentiary issues, motions to challenge or reduce damage awards, and the tax treatment of compensatory damages.
