This Law Firm Publication by Jackson Lewis P.C. discusses Public Act 16-95, recently signed into law by Connecticut Governor Dannel Malloy and establishing significant new restrictions on physician non-compete agreements in Connecticut. Under the new Act, an existing physician covenant not to compete is valid and enforceable only if necessary to protect a legitimate business interest, and must be reasonably limited in time, geographic scope, and practice restrictions. In addition, for covenants entered into, amended, or renewed on or after July 1, 2016 restrictions must not be for longer than 1 year or beyond 15 miles from the primary site where the physician practices.
