This Law Firm Publication by Jackson Lewis P.C. discusses two new Arizona laws concerning independent contractors. One law allows employers to have workers sign a declaration creating a rebuttable presumption of the existence of an independent contractor relationship. The law, which provides effective sample language for the declaration, takes effect August 6, 2016. Any supervision or control exercised by the employer to comply with federal or state law cannot be used to determine independent contractor status. Under another new law, individuals or entities using a qualified marketplace platform's digital platform to provide services to third-party individuals are classified as independent contractors. The qualified marketplace contractor is deemed an independent contractor if payment for services includes all services performed and an effective written contract exists between the parties.
