In Docket No I ZB 76/15, the German Federal Court of Justice considered whether, as an appeal court, it was entitled to interpret the content of a foreign arbitral award without reference to the applicable foreign law, in order to decide whether an arbitral tribunal had made a binding decision relevant to the enforceability of an award.
