This Practice Note discusses waiver of the attorney-client communication privilege (often called the attorney-client privilege or lawyer-client privilege), which protects from disclosure or production to third parties confidential communications between an attorney and a client (or their respective representatives) made for the purpose of obtaining or rendering legal services. This Note analyzes the key issues to consider in determining who can waive the privilege, how a waiver may occur, and the extent and scope of any waiver.
