A Practice Note describing the rules and procedure for venue in New York state supreme court under Civil Practice Law and Rules (CPLR) Article 5. This Note explains venue based on residency, the place of occurrence, forum selection clauses, and under the rules for certain types of actions. This Note also addresses motions to change venue as of right and on discretionary grounds, such as for witness convenience and to obtain an impartial trial, and appellate review.
