A legal update on the announcement by the Department of Commerce's Bureau of Industry and Security (BIS) that the rule regulating reporting requirements for restrictive trade practices or boycotts under the Export Administration Regulations (EAR) has been amended to permit electronic submissions as an additional method for filing.
The antiboycott reporting requirements under the Export Administration Regulations (EAR) have been amended to allow for electronic filing. The amendment is effective October 14, 2016.
Antiboycott laws require US persons to report quarterly any requests they have received to take certain actions to comply with, further, or support an unsanctioned boycott. Filers were previously only permitted to submit the required forms by mail. The amended rule now allows reports tobe submitted either by mail or electronically.
Antiboycott filers must file one of the following forms, both of which are available on the BIS website:
  • BIS 621-P for single transactions, which may be submitted by mail or electronically.
  • BIS 6051P for multiple transactions received in the same calendar quarter, which still must be submitted by mail under the amended rule.
