A Practice Note addressing the scope of excepted benefits under the Employee Retirement Income Security Act of 1974 (ERISA), the Internal Revenue Code (Code), and the Public Health Service Act (PHSA). Certain requirements under ERISA, the Code, and the PHSA (including under the Affordable Care Act (ACA)) do not apply to excepted benefits.
