Court and Judge Rules Update: November 23-29, 2016

This Legal Update reports on significant changes to the local civil and criminal rules and procedures for all US federal district courts and appellate courts between November 23 and 29, 2016. It also reports on changes to the individual civil and criminal practice rules for the judges in select district courts during this period.
US Supreme Court
The Supreme Court adopted the following rules amendments which were transmitted to Congress on April 28, 2016:
- Appellate Rules 4, 5, 21, 25, 26, 27, 28, 28.1, 29, 32, 35, and 40, and Forms 1, 5, 6, and new Form 7 and new Appendix.
- Bankruptcy Rules 1010, 1011, 2002, 3002.1, 7008, 7012, 7016, 9006, 9027, and 9033, and new Rule 1012.
- Civil Rules 4, 6, and 82.
- Criminal Rules 4, 41, and 45.
These rules amendments are effective December 1, 2016.
DC Circuit
DC Circuit Court of Appeals
The US Court of Appeals for the DC Circuit posted an order adopting an amendment to Local Circuit Rule 28(a)(2), effective December 1, 2016.
First Circuit
District of Maine
The US District Court for the District of Maine posted a notice regarding amendments to Local Rules 7, 16.2, 54.3, 67, and 83.1, effective December 1, 2016.
Second Circuit
District of Connecticut
The US District Court for the District of Connecticut posted a notice of fee increase and amendment of Local Civil Rule 83.1.
Third Circuit
Third Circuit Court of Appeals
The US Court of Appeals for the Third Circuit posted an order vacating Option B of the Clerk's Order dated March 17, 2009, which had permitted attorneys to file an appendix in paper form.
Fourth Circuit
Fourth Circuit Court of Appeals
The US Court of Appeals for the Fourth Circuit posted a notice regarding new Local Rule 29, effective December 1, 2016.
District of Maryland
The US District Court for the District of Maryland posted a notice of attorney admissions fee increase, effective January 1, 2017.
Eastern District of North Carolina
The US District Court for the Eastern District of North Carolina posted Standing Order 16-SO-4, amending its local admiralty rules, local civil rules, local criminal rules, and local patent rules, effective December 1, 2016. The court also provided summaries and redlines for these rules:
Fifth Circuit
Eastern and Western Districts of Kentucky
The US District Courts for the Eastern and Western Districts of Kentucky posted joint General Order 16-02 regarding criminal subpoenas for the production of books, documents, data, or objects in advance of a trial or hearing.
Sixth Circuit
Sixth Circuit Court of Appeals
The US Court of Appeals for the Sixth Circuit posted a chart summarizing the new length limits required by the Federal Rules of Appellate Procedure, effective December 1, 2016.
Seventh Circuit
Central District of Illinois
The US District Court for the Central District of Illinois posted a notice eliminating Local Civil Rules 5.3(D) and 67.2, and Local Criminal Rule 49.3(D), effective December 1, 2016.
Eighth Circuit
Eighth Circuit Court of Appeals
The US Court of Appeals for the Eighth Circuit revised its rules, effective December 1, 2016, by:
- Amending local rules 25A(b) and 25A(c).
- Deleting local rules 3B and 33A.
The court also updated its fee schedule, effective December 1, 2016.
Ninth Circuit
Central District of California
Judge George H. Wu revised his order for discovery and inspection in criminal cases to reflect his courthouse change. A copy of the previous version is available here.
Northern District of California
The US District Court for the Northern District of California revised the following forms:
District of Oregon
The US District Court for the District of Oregon posted Standing Order 2016-12 regarding the amendment of Local Rule 5.
Eastern District of Washington
The US District Court for the Eastern District of Washington revised its civil cover sheet.

The US District Court for the Southern District of Florida posted Administrative Order 2016-56 regarding amendments to Local Civil Rules 5.1, 7.1, 11.1, and 26.1, and Local Criminal Rule 88.10, effective December 1, 2016.
