A Practice Note on sanctions for the failure to preserve electronically stored information (ESI) under Federal Rule of Civil Procedure (FRCP) 37(e) in federal civil litigation. This Note addresses the requirements for imposing sanctions for ESI spoliation under FRCP 37(e), as well as the types of sanctions that the rule permits.
