A notice by US Citizenship and Immigration Services (USCIS) reminds EB-5 regional centers that received designation before September 30, 2016, that they must submit Form I-924A to USCIS by December 29, 2016. Form I-924A is used to show the continuing eligibility for regional center designation.
In a notice issued on December 7, 2016, US Citizenship and Immigration Services (USCIS) reminded EB-5 regional centers with designations issued before September 30, 2016 that they must file Form I-924A by December 29, 2016.
Form I-924A is used by a regional center to show continuing eligibility for the regional center designation. It must be filed with USCIS no later than December 29th each year (90 days after the government's fiscal year ends on September 30th).
A regional center that fails to file the Form I-924A will receive a USCIS notice of intent to terminate participation in the EB-5 program. A regional center that files an incomplete form may also receive a notice of intent to terminate. Regional centers may overcome a notice of intent to terminate by responding to the notice with evidence of continuing eligibility and an explanation for its failure to timely file the Form I-924A. Centers that have been terminated from the EB-5 program are prohibited from soliciting, generating, or promoting investors or investments for any other EB-5-related projects or participating in the EB-5 immigrant investor program in any way.
