This Practice Note discusses the Equal Employment Opportunity Commission's (EEOC) systemic litigation program. In particular, this Note discusses the EEOC's authority to file lawsuits to remedy systemic, pattern or practice, or class-based employment discrimination, what pre-suit obligations the EEOC must comply with before filing a systemic lawsuit, and judicial review of EEOC investigations and conciliation in systemic cases. This Note is based on Sections 706 and 707 of Title VII of the Civil Rights Act of 1964 and other federal anti-discrimination laws and applies to federal lawsuits against private employers.
