A Practice Note discussing the exemptions under the federal Fair Labor Standards Act (FLSA) applicable to sales employees. This Note addresses the requirements for the outside sales, commissioned retail sales (also referred to as Section 7(i) or inside sales), and vehicle sales and service exemptions, including a discussion of promotion work, drivers who sell, retail or service establishments, and service advisors. State or local law may impose different or additional requirements for exemption.
