Cartel Enforcement Year in Review: 2016 | Practical Law

This Article reviews the cartel enforcement actions brought by the Antitrust Division of the Department of Justice (DOJ) in 2016. The DOJ continued its focus on the auto parts cartel, while also bringing criminal charges against companies and individuals in the real estate foreclosure auction and roll-on, roll-off cargo cartels, among others. While the DOJ filed a similar number of charges against individuals and companies alleging anticompetitive cartel conduct in 2016, it collected significantly less in fines than in 2015 because of the large fines collected in 2015 from the FX spot cartel and roll-on, roll-off cargo cartel.
