As usual, we have published our regular monthly roundup of key items for general counsel, GC Agenda China (see Article, GC Agenda China: January 2017) and separate legal updates for important legal and practical developments in this month (see Legal updates) and have updated a number of materials in the light of recent developments (see Maintenance).

New content

IP & IT

We have published Article, Data protection at home and abroad: a comparison of approaches. This article looks at data protection legislation generally, as well as more specific areas such as approaches to data breach notification, data export and the "right to be forgotten". The article also has a table to summarise the data protection legislation in place across various jurisdictions in Asia Pacific.

Employment and benefits

We have published Practice note, Intern management in China. This note considers issues relating to the legal status of internships, rights and benefits of interns, documenting an internship agreement and restrictions on using interns. This note also addresses practical intern management issues frequently encountered by intern-accepting entities in China, including de facto employment and work-related injuries of interns.

GC Agenda China: January 2017

The new GC Agenda China is now out. GC Agenda China provides practical, specific and actionable advice on key issues for GC covering China. GC Agenda China is also a useful reference point for external counsel who needs an overview of the main developments outside their own practice area.
This month's GC Agenda China covers:
  • SPC's 15th batch of guiding cases.
  • NPC's third draft of Civil Code.
  • NPC's draft e-commerce law.
  • MLR's replies on automatic renewal of residential construction land use rights.
  • State Council's rules on fixed asset investment project verification and record-filing.
  • MOJ's opinions on strengthening foreign-related legal services industry.
